Wildlife services

Animals and plants
Legislation surrounding animals and plants is extremely complex with some species offered greater protection and a whole host of exceptions. For example, taking, injuring or killing animals or birds, and picking or uprooting plants without owners’ permission may constitute offences. We are able to offer experienced advice and representation tailored to your precise circumstances.

Specific legislation
Holdens offers comprehensive advice on all aspects of the following legislation:

  • Wildlife and Countryside Act 1981
Provides basic protection for specific wildlife species in Britain.
  • Badger Protection Act 1992
Safeguards badgers against interference, mentions special
    exclusions permitted
    Acts and licences
  • Countryside and Rights of Way Act 2000
Deals with rights of way, strengthens Sites of Special Scientific Interest principles, includes new provisions against offences in the 1981 act.
  • Habitats Regulations
Creates schedules of protected species, including great crested newts, bats,
    dormice and otters.

Pesticides
Anyone who advertises, sells, supplies, stores or uses pesticides is subject to potentially complicated legislation, including Control of Pesticides Regulations, Plant Protection Products Regulations and the Control of Substances Hazardous to Health. Holdens assists, advises and represents in connection with all pesticide matters.

Our experienced lawyers are able to arrange visits and to provide lectures to interested groups regarding practice and procedure should difficulties around wildlife law affect you. Contact us for further details.
